RELEASE, ASSUMPTION OF RISK, WAIVER AND INDEMNIFICATION This document waives important legal rights. Read it carefully before signing. Guest intends to participate in a guided vineyard tour (the “Vineyard Tour”) organized and led by Sutro Wine Co., LLC (“Sutro Wine”). The Vineyard Tour will take place on property owned by Warnecke Ranch and Vineyard II Limited Partnership, a California limited partnership (“Warnecke”), where grapes used by Sutro in its wine making process are grown. The property on which the Vineyard Tour will be conducted is known as the “Warnecke Ranch.” Guest agrees as follows: I understand that Sutro Wine is an independent business owned and operated separately from Warnecke, and that Sutro Wine is not an owner or operator of the Warnecke Ranch property. The Vineyard Tours on the Warnecke Ranch are designed, organized, and led by Sutro Wine and its contractors, agents and employees. Warnecke makes no representations, warranties or assurances about the quality or safety of the vineyard tours organized and led by Sutro Wine.

1. Liability Release. I choose to participate voluntarily in the Vineyard Tour. I understand that touring vineyards involves being in remote areas for extended periods of time, far from communication, transportation, and medical facilities; that these areas have many natural and man-made hazards which cannot be anticipated, identified, modified or eliminated. I further understand that vineyard touring involves such things as walking across uneven or steep terrain, potential exposure to chemicals and fertilizers employed in vineyard management and care, walking along unpaved roads, encountering vehicles transporting workers in the vineyards, all of which makes vineyard touring a hazardous activity that could result in injury to me or in my death. I understand these risks and voluntarily assume them and the concomitant dangers.

I am fully aware and acknowledge that participating in a vineyard tour involves inherently dangerous risks of accident or serious bodily injury, including tripping, falling, broken bones, head injuries, pain, suffering or even death (hereinafter referred to collectively as “Harm”) to me.

I hereby assume the risk of Harm relating to my participation in the Vineyard Tour and I release Sutro and Warnecke, their Managers, Members, General Partners, Limited Partners, shareholders, directors, officers, contractors, agents and employees from all claims for money damages or otherwise for any Harm arising from or related to my participation in the Vineyard Tour.

I understand that I am responsible for any medical expenses or other expense incurred as a result of bodily injury or property damage I may suffer on the Vineyard Tour.

SIGNER STATEMENT OF AWARENESS I represent that I have read and understand the forgoing Liability Release and Assumption of Risk Agreement. I understand that by signing this document, I am giving up legal rights to sue today and in the future. I attest that all facts contained herein are true and accurate. I represent and warrant that I am at least 18 years old. I am signing this while of sound mind and not suffering from shock or under the influence of alcohol, drugs or other intoxicants. DO NOT SIGN BELOW UNLESS YOU HAVE THOROUGHLY READ, UNDERSTOOD AND AGREED TO THE ENTIRE CONTENTS OF THIS RELEASE FORM.
